I think so. The case might be one of the followings:

1. Your modem card is realllllly old and have don't have 16550A
   serial UARTS
   (if you have interest what's 16450, refer the CTS Serial Port FAQ
    http://www.comminfo.com/pages/ctsfaq01.htm#q6unbuffered)

2. Your serial driver or cardmgr doesn't work correctly.

I'll bet on the 2nd case. I don't know how to fix. One way I may
suggest is kernel upgrade. I now use 2.4.7-rmk3-np1-devfs series.
(it may needs repartition and reflash)

I don't.
/bin/fuser is not critical. That's just for cleanup thing.
You may set NO_FUSER option on serial.opts to avoid the message.
